1. Acceptance of Terms

By accessing bcatt.com or registering for an account on web.bcatt.com, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. Your continued use of the platform following any updates to these terms constitutes acceptance of the revised terms.

2. Description of Service

BCATT is a SaaS (Software as a Service) platform that allows businesses to create and manage a digital product catalog website, which can be shared via a unique URL. Services include product management, catalog hosting, shareable catalog links, and customer inquiry tools.

3. Account Registration

To use BCATT, you must register an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account. BCATT is not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use Policy

You agree to use BCATT only for lawful purposes. You must not use our platform to:

• Create catalogs for products or services that are illegal under the laws of India
• List, promote, or sell any product or service that is banned, restricted, or requires special licensing under Indian law
• Publish obscene, pornographic, hate-based, or defamatory content
• Promote or facilitate gambling, narcotics, counterfeit goods, or any other illegal activity
• Infringe on intellectual property rights of any third party
• Engage in spamming, phishing, or any form of fraudulent activity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the platform in any way that violates the Information Technology Act, 2000, or any other applicable Indian law

BCATT reserves the right to suspend or permanently terminate any account found to be in violation of this Acceptable Use Policy, without prior notice and without any refund.

5. User Content

You retain ownership of all product information, images, and content you upload to your catalog. By uploading content, you grant BCATT a non-exclusive, royalty-free license to host, display, and deliver that content as part of operating your catalog. You represent and warrant that you have the right to use all content you upload and that it does not violate any law or third-party rights.

6. Subscription and Payment

BCATT offers annual subscription plans as described on our Pricing page. All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Subscriptions are billed annually and are non-transferable. Access to the service is contingent upon timely payment of the applicable subscription fee.

7. Service Availability

We strive to maintain high availability of the BCATT platform. However, we do not guarantee uninterrupted access and are not liable for any downtime caused by maintenance, technical failures, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled maintenance.

8. Intellectual Property

All elements of the BCATT platform — including its software, design, trademarks, and content created by us — are the exclusive intellectual property of BCATT. You may not copy, reproduce, modify, distribute, or create derivative works from any part of our platform without our explicit written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BCATT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of or inability to use our services. Our total liability shall not exceed the amount paid by you for the subscription in the preceding twelve months.

10. Termination

You may cancel your account at any time. BCATT reserves the right to suspend or terminate your account immediately, with or without notice, for violation of these Terms of Service. Upon termination, your catalog will be taken offline and your data may be deleted after a reasonable retention period.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these terms or the use of BCATT services shall be subject to the exclusive jurisdiction of the courts located in Moradabad, Uttar Pradesh, India. By using our services, you irrevocably consent to this jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of BCATT after any such changes constitutes your acceptance of the new terms.
